Laws covering vaping products differ from state to state, and they change often — a rule that was true last year may not apply this year. This page is a practical summary of what affects an order placed with us, current as of October 2026. It is not legal advice; where a state rule matters to you, check the state authority linked at the bottom.

Federal rules that apply everywhere

• 21+ only. Federal law set the nationwide minimum age for tobacco and nicotine products at 21 (Tobacco 21). We verify age at checkout and again at delivery.
• Online sales are regulated. Under the amended PACT Act, e-cigarette and nicotine sales by remote sellers require identity verification at purchase and at delivery, adult-signature shipping, package labelling, and reporting to state tax authorities. The USPS is prohibited from carrying these products — parcels move by private carrier only.
• FDA authorization. Vaping products sold in the US must have FDA marketing authorization. We buy from established brands through authorised distribution, and every device carries a manufacturer verification code.
  States with statewide flavor restrictions These states restrict the sale of flavored vaping products, generally leaving tobacco, menthol-free tobacco or unflavored products as the only compliant options:

If you are in one of these jurisdictions, flavored items will be blocked at checkout and only compliant products will be offered to your address. Orders placed from a restricted address for restricted items are cancelled and refunded.

States that restrict how online orders can be delivered Some states require face-to-face sales for nicotine products, or require the seller to hold a state licence before shipping in. Where that applies, checkout will not offer shipping to your address, and the item can only be bought in person at our Tustin counter. We do not route around these rules by relabelling parcels or shipping to a third-party address.

Excise tax and licences Many states add a specific excise tax on vaping products on top of sales tax, and some require the seller to be licensed or registered. Where a state tax applies, it is calculated and shown at checkout before you pay — we do not absorb it silently into the product price.

Local rules Cities and counties can be stricter than their state. Chicago, Denver, Boulder, Aspen, Carbondale and New York City, for example, have their own flavor rules. If you are near a county or city line, check the local ordinance as well as the state one.

What this means when you order

• Your delivery address determines which products can be shown and shipped
• Restricted items are blocked before payment, not after
• Every parcel ships with adult signature required and cannot be left unattended
• If an order slips through that should not have, we cancel and refund it in full
